1. Agreement
These terms are between BMSVT Enterprises LLC ("we", "us") and the department that registers for DeptFireShift Pro, and each person who uses it. The person who registers a department confirms they're authorized to accept these terms for it. By using DeptFireShift Pro you agree to these terms and our privacy policy.
2. Accounts and roles
Each department has one Chief, who may appoint co-admins and one co-admin who manages billing. The Chief seat can be handed to another person, who must accept it. Members join only by invitation. Keep your password private; you're responsible for activity under your account. Tell us at once if you think your account has been misused.
3. Your department's data
Your department owns the records it enters. You give us permission to store and process them only to provide the service. You're responsible for having the right to enter the information you add, including other people's details.
4. Billing
- The department pays per active member, monthly or yearly, at the prices on our pricing page. Members don't pay.
- New departments get a 30-day free trial. A card is required to start it, and the first charge is at the end of the trial unless you cancel first.
- Subscriptions renew automatically. Adding members raises the charge right away, prorated; removed members come off at the next renewal.
- If a payment fails, access continues for 14 days while we send reminders, then the department is locked until payment is made.
- You can cancel any time. You keep access until the end of the period you've paid for and won't be charged again.
- Payments are non-refundable, except where we've billed you in error or the law requires a refund.
- We'll give at least 30 days' notice by email before changing prices.
5. Payroll and pay calculations
DeptFireShift Pro calculates hours and pay from the schedule, rates and rules your department enters, and can produce a file for your payroll system. It is a tool to help prepare payroll. It isn't a payroll provider and doesn't give legal, tax or labor-law advice. Your department is responsible for its pay rules and for checking hours and amounts before anyone is paid, and should run a test import before relying on a payroll file.
6. The AI assistant
The optional assistant can answer questions and suggest entries. Its answers can be wrong, so check anything important. It only saves a change after you confirm it.
7. Acceptable use
Don't try to access another department's data or another person's account, interfere with the service, reverse-engineer it, register a department you aren't authorized to represent, or use it for anything unlawful. We may suspend access that puts the service or other departments at risk.
8. Ending your account
When a department's subscription ends, it's locked and its data is kept; department admins can download it, and restoring billing brings it back. To have a department's data permanently deleted, contact us. You can delete your own account at any time; your login and personal data are permanently deleted after 60 days, and records you entered in a department stay with that department. We may end the service for a department that breaks these terms, with notice where we reasonably can.
9. Disclaimers and liability
We work to keep DeptFireShift Pro accurate and available, but it's provided "as is" without warranties beyond those the law requires. To the extent the law allows, we aren't liable for indirect or consequential losses, and our total liability for all claims relating to DeptFireShift Pro is limited to the amount the department paid us in the 12 months before the event that gave rise to the claim.
10. Law, changes and contact
These terms are governed by the laws of the State of Vermont. If we change them, we'll update the date above and email department admins about significant changes before they take effect.
